Lawyers rules to change

ON 13 MAY 2014, the NSW Legislative Council passed the Legal Profession Uniform Law Application Bill 2014.

The new Act will repeal the Legal Profession Act and introduce the Legal Profession Uniform Law early next year, enabling a single national framework for the regulation of the profession.

Google Spain SL, Google Inc v Agencia Española de Protección de Datos, Mario Costeja Gonzalez

ON 13 MAY 2014, the Court of Justice of the European Union delivered its judgment in case C-131/12 Google Spain SL, Google Inc v Agencia Española de Protección de Datos, Mario Costeja Gonzalez.

If a search engine shows a link to a web page containing personal information, the data subject may approach the search engine operator and request that the link be removed from the list of results and if the request is not granted, bring the matter before competent authorities to have the link removed.

The ruling applies to the European Union Member States but is likely to have an impact world wide.

ON 2 APRIL 2014, the High Court of Australia delivered NSW Registrar of Birth, Deaths and Marriages v Norrie [2014] HCA 11 (2 April 2014).

The High Court held that a person’s sex can be registered as “non-specific”.
